1. Introduction
These Terms & Conditions ("Terms") govern your use of CueBeat, operated by Sirena Clark ("CueBeat", "we", "us"). By creating an account or continuing to use the service, you agree to be bound by these Terms.
2. What CueBeat is
CueBeat is an AI-assisted Pilates class planning and teaching platform. Instructors build classes with sequenced exercises, cueing, and music. Students can join, bookmark, and follow along with published classes.
CueBeat is a wellness and educational tool. It is not medical advice, diagnosis, or treatment, and does not replace a qualified instructor or clinician.
3. Age & eligibility
You must be at least 13 years old to use CueBeat. If you are under 18, a parent, guardian, or supervising school must authorize your use. You are responsible for the confidentiality of your account credentials and for activity under your account.
4. School pilots & supervision
School pilots are staff-supervised at all times. CueBeat supports instructors — it does not replace them.
Schools running a CueBeat pilot must (a) confirm students are age 13 or older, (b) assign a supervising staff member for every session, (c) use pseudonymous student labels where practical, and (d) send appropriate parent/guardian notice or authorization per school policy. The specific pilot commitments are described in our Privacy Notice and a separate pilot packet / school agreement provided on request to hello@cuebeatpilates.com. The pilot posture is a discussion draft, not a certification.
5. Acceptable use
You agree not to:
- Use the service for any unlawful purpose or to harass, harm, or endanger others
- Engage in fraud, spam, scraping, or deceptive practices
- Infringe on the intellectual property or privacy rights of others
- Attempt to interfere with the security or integrity of the service, including probing, penetration testing without authorization, or distributing malware
- Use the service to provide medical advice, diagnosis, or treatment
6. Subscriptions & payments
CueBeat offers subscription plans with a trial period and one-time purchases for individual classes. Payments are processed by Stripe; CueBeat never sees or stores your full card number.
Subscriptions renew automatically at the end of each billing period at the then-current price until canceled. You can cancel anytime from Settings → Manage Billing; cancellation takes effect at the end of your current paid period and you keep access until then. Taxes are calculated at checkout based on your billing location. Refunds are covered by our Refund Policy.
7. Intellectual property
All rights in CueBeat — software, design, branding, and documentation — remain the property of Sirena Clark. You receive a limited, non-exclusive, non-transferable license to use the service under your plan. You may not reverse-engineer, resell, or redistribute the service.
You retain ownership of content you create through CueBeat (class plans, cue text, etc.). You grant us a limited license to host and process that content solely to provide the service to you and, where you choose to publish, to the students you invite.
8. Service availability
We aim to keep CueBeat available and responsive but do not guarantee uninterrupted or error-free operation. We may perform maintenance or updates that temporarily affect availability.
9. Suspension & termination
We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your right to use the service ends immediately. You may request an export of your data within 30 days of termination by contacting us.
10. Wellness disclaimer & assumption of risk
CueBeat is a wellness and educational tool for Pilates practice and teaching. It is not medical advice, diagnosis, or treatment, and it does not replace a qualified instructor or clinician. Consult a qualified healthcare provider before starting any exercise program — especially if you are pregnant, injured, or have a medical condition.
Physical exercise carries inherent risk. By using CueBeat you voluntarily assume the risks associated with performing any exercise, sequence, or class accessed through the service. Instructors and school staff are responsible for the safety, suitability, and supervision of any class they lead using CueBeat, and for confirming participants can safely perform the exercises.
11. Limitation of liability
CueBeat is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, our aggregate liability for any claim relating to the service is limited to the fees you paid CueBeat in the twelve months preceding the claim. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law (for example, fraud, death, or personal injury caused by our negligence).
12. Indemnification
You agree to indemnify and hold us harmless from claims arising from your content, your use of the service in breach of these Terms, or your violation of applicable law.
13. Disputes
You and CueBeat will attempt to resolve disputes informally first by writing to hello@cuebeatpilates.com. If not resolved, disputes will be handled in accordance with applicable law. Neither party may bring a claim as a plaintiff or class member in a purported class or representative proceeding. Nothing prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property.
14. General
These Terms are governed by the laws of the United States (and, where applicable, of the state you or your school reside in). We may assign these Terms in connection with a merger or acquisition; you may not assign your rights without our consent. Failure to enforce any provision is not a waiver. If any provision is unenforceable, the rest remain in effect. Neither party is liable for delays caused by events beyond reasonable control.
